These Terms and Conditions ("Terms") govern all SMS messages sent and received as part of the A2P 10DLC messaging services provided by Launching Flow LLC ("Launching Flow," "we," "us," or "our"). By opting in to receive SMS communications from Launching Flow, you agree to be bound by these Terms. If you do not agree, please do not use our messaging service.

Messaging Consent

By providing your mobile phone number and opting in to receive messages, you expressly consent to receive SMS and/or MMS messages from Launching Flow. Messages may include, but are not limited to:

Appointment reminders and confirmations

Service alerts and status updates

Promotional offers and announcements

Follow-up communications related to our services

Other relevant business communications

Message frequency will vary based on your interaction with our services and your communication preferences. You will not be charged by Launching Flow for SMS messages; however, standard message and data rates may apply based on your mobile carrier plan.

Opt-Out Instructions

You may opt out of receiving SMS messages from Launching Flow at any time by replying STOP to any message we send you. After opting out, you will receive a single confirmation message and no further messages will be sent, except as required by law.

To re-enable SMS messages after opting out, reply START to any previous message or contact us directly.

Data Rates and Charges

Standard message and data rates may apply to SMS messages you send or receive through our service. Rates are determined by your mobile carrier and the terms of your wireless plan. Launching Flow is not responsible for any charges applied by your carrier.

Your privacy is important to us. Our Privacy Policy, available on our website, describes how we collect, use, store, and protect your personal information — including information collected in connection with our A2P 10DLC messaging service. By using our messaging service, you also agree to the terms of our Privacy Policy. We do not sell, rent, or share your phone number or personal information with third parties for their own marketing purposes.

Message Delivery

Launching Flow will make reasonable efforts to deliver messages in a timely manner; however, we do not guarantee the delivery, timeliness, or accuracy of any SMS message. Delivery failures or delays may occur due to factors outside our control, including but not limited to:

Mobile network congestion or outages

Carrier filtering or restrictions

Device compatibility issues

Geographic limitations

Launching Flow is not liable for any damages or losses arising from delayed, undelivered, or misdirected messages.

User Obligations

By using our messaging service, you agree to:

Provide accurate and current contact information;

Use the service only for lawful purposes and in compliance with all applicable laws and regulations;

Refrain from using this service to send, upload, or facilitate the transmission of messages that are unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, or otherwise objectionable;

Not attempt to circumvent, reverse engineer, or interfere with our messaging systems or infrastructure.

Any misuse of our messaging service may result in immediate termination of your access without notice.

Compliance with Laws

Both Launching Flow and users of our messaging service must comply with all applicable federal, state, and local laws governing SMS communications, including but not limited to:

The Telephone Consumer Protection Act (TCPA);

The CAN-SPAM Act;

CTIA Messaging Principles and Best Practices;

Federal Communications Commission (FCC) regulations;

All applicable state telecommunications and privacy laws.

Limitation of Liability

To the fullest extent permitted by applicable law, Launching Flow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our messaging services. Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you, if any, for access to our services in the twelve (12) months preceding the claim.

Changes to These Terms

Launching Flow reserves the right to modify these Terms at any time. Material changes will be communicated through our website, via direct SMS notification, or by email where feasible. Your continued use of our messaging service after any changes take effect constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
